One provision in the latest federal budget bill could prohibit a broad array of hemp-sourced cannabinoid products beginning in November 2026.

The proposal closes the hemp “gap,” originating from the 2018 Farm Bill, and possibly reshapes a $28 billion-dollar industry.

Proponents warn that the restriction may limit access and drive many to more dangerous, unsupervised substitutes.

Closing the Hemp ‘Opening’

That bill essentially closes the hemp “gap” stemming from the 2018 Farm Bill. The piece of regulation crafted a description for hemp distinct from cannabis.

That bill defined hemp as any type of cannabis species or its extracts containing no higher than 0.3% delta-9 THC by dry weight.

Delta-9 THC is the most plentiful, intoxicating substance present in cannabis.

Weed and hemp are the two varieties of the cannabis plant, but they are structurally distinct. Whereas hemp includes less than 0.3% THC, marijuana has much higher.

That designation specified in the Farm Bill recategorized hemp as an agricultural commodity; simultaneously, marijuana remains an prohibited Schedule 1 substance.

How the New Bill Redefines Hemp

The appropriations bill stipulation introduces radical modifications to how hemp is described at the national stage.

That revised description states that hemp could contain no more than 0.4 milligrams of combined THC per vessel. A “vessel” is specified as the “deepest enclosure, wrapping or receptacle in immediate proximity with a final hemp-sourced cannabinoid good.”

Additionally, cannabinoids that are manufactured or manufactured outside the species will be outlawed. Delta-eight THC, for example, actually inherently appear in cannabis, but in minimal amounts.

Could the Bill Constrain the Sale of CBD Goods?

Several people depend on CBD for health and healing uses.
